Cashmere Craft Establishment files defamation suit against Punjab National Bank

Srinagar, Oct 1, CNS: Cashmere Craft Establishment has filed a defamation case against Punjab National Bank accusing it of damaging his business and reputation in the society.

Punjab National Bank (PNB) had recently published a notice declaring Cashmere Craft Establishment as ‘willful defaulter.

The owner of the Cashmere Craft Establishment in his legal notice through his Counsel Isfaq Muzamil Nahvi to the said Circle Head of the Bank reads that: “public didn’t know that the default was actually on the part of your Bank who has been trying to cause unnecessary harassment to my client one way or the other with malafide intentions to force him to withdraw his complaint lodged by him against the Bank under Consumer Protection Act before the Jammu Kashmir State Consumer Commission, Srinagar, wherein my client has claimed compensation to the tune of Rs 85 lakhs on account of your Banks failure to adhere to the terms and conditions of loan by keeping my clients stock uninsured which were totally destroyed in the devastating 2014 floods.”

The legal notice further reads that the public didn’t know that your Bank had previously issued many false, baseless and concocted notices and correspondences to my client including one under SARFAESI Act, which my client in terms of the provisions of the Act has challenged before the Court of Principal District Sessions Judge Srinagar, which is still pending.

The legal notice says that Bank had no right to issue a public notice when the matter is subjudice. “The shameful, illegal and unwarranted act on your part has given a cause of action to my client to lodge a criminal complaint defamation against you under the relevant provisions of RPC and has also rendered my client entitled to claim damages to the tune of Rs 10 Crore.”

Besides Ansari’s, the PNB in its notice had named Mir Fanoon Rafiq, proprietor of M/S Cashmere Craft Gole Market Karan Nagar Srinagar as a ‘Wilful Defaulter’.

Rafiq as per notice owns Rs 80, 39, 313 to the bank excluding interest and his account has been declared NPA on 01-01-2012 while he has been declared ‘Wilful Defaulter’ on 07-12-2015. (CNS)
